TERMS OF SERVICE

Please read these Terms of Service (“Terms”, “Terms of Service”) carefully before using The Beauty Palace mobile application (the “Service”) operated by Univatrix Technologies (“us”, “we”, or “our”).


1. Acceptance of Terms

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the Terms, then you may not access the Service.


2. Prohibited Activities

You agree that you will not engage in any of the following prohibited activities while using the Service:

  1. Bullying or posting suggestive content
  2. Engaging in fraudulent activities, including but not limited to making fake bookings or attempting to defraud service providers or other users of the Service
  3. Using the Service for any illegal or unauthorised purpose

3. Legal Action for Fraudulent Activities

We reserve the right to take legal action against any user who engages in fraudulent activities while using the Service.


4. Quality of Service

We are not held accountable for the quality of service provided by service providers listed on the Service. Any disputes regarding the quality of service should be resolved directly between the service provider and the customer.


5. Non-Payment by Customers

We are not held accountable for customers who fail to pay for services booked through the Service.


6. Responsibility during Appointments

Once an appointment is booked and commences, we do not assume any responsibility for what happens during the appointment, including but not limited to any accidents, injuries, or disputes that may occur.


7. Fake Bookings

We are not held responsible for customers making fake bookings. However, service providers have the right to report such cases to us for investigation.


8. Appointment Cancellations

We are not held responsible for service providers or customers cancelling booked appointments.


9. In-App Payments

The Service does not offer in-app payments to service providers. Financial transactions between service providers and customers must be handled directly by the service provider. We will not assume any responsibility for any financial loss incurred by service providers.


10. Account Verification

Service providers are required to verify their account in order to use this service, in compliance with the Electronic Communications and Transactions Act (ECTA) of South Africa. Account verification may include providing valid identification documents or other necessary information as requested by us. Failure to verify the account may result in the suspension or termination of access to the Service.


11. Compliance with South African Law

By using the Service, you agree to comply with all applicable laws and regulations in South Africa, including but not limited to the ECTA and the Protection of Personal Information Act (POPIA). Failure to comply with these laws may result in legal action taken against you.


12. User Conduct

Users are expected to conduct themselves in a respectful and lawful manner while using the Service. Any violations of community guidelines or misconduct may result in the termination of access to the Service.


13. Intellectual Property

Users retain ownership of content uploaded to the app, but grant us a license to use such content for the purposes of providing the Service. Users may not use intellectual property belonging to the app or other users without permission.


14. Termination of Service

We reserve the right to terminate accounts and access to the Service for violations of the Terms of Service or other misconduct, without prior notice.


15. Dispute Resolution

Any disputes arising from the use of the Service shall be resolved through mediation or arbitration, in accordance with South African law.


16. Limitation of Liability

We shall not be liable for any damages arising from the use of the Service, to the extent permitted by law.


17. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of South Africa.


18. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days’ notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
